The DOJ says since Trump was charged last year, putting him on trial close to the election would not technically run afoul of its policy about not interfering in elections. But, asks CNN’s Michael Smerconish, does AG Merrick Garland want to risk putting a former President on trial when he’s his party’s nominee?
